There is an omission in the exemption criteria applicable to children in foster care on page 4700 at 440.315(h).
The Social Security Act provides at section 1937(a)(2)(B)(viii) for the an exemption from Alternative Benefit Plans as follows: "The individual is an individual with respect to whom child welfare services are made available under part B of title IV on the basis of being a child in foster care ..." The regulations fail to include the exemption of these IV-B foster care children and therefore should be revised to include this group of individuals.
