Recommend that there be an exception to having the requirements activity include a statement to the contracting officer that the item is or is not on the USML. This exception would be for those items that include "critical military technology", as they are already protected (restricted to U.S. and Canadian firms) as a firm must submit a DD2345 prior to receiving a solicitation and associated technical data package for these types of items. Therefore, a communist Chinese military company would not be able to receive any solicitation or submit an offer for these types of items because of the "critical military technology" designation. Having the requirements activity provide the statement in these cases is redundant and is not in line with Lean Six Sigma. This comment is submitted with the realization not all of the items on the USML include "critical military technology" therefore, that is why there should be an "exception" as it is not being suggested that the entire requirement be removed.
