I am greatly concerned with certain provisions of this proposal. While I
understand the need for combating terrorism, I do not feel that this proposal,
as written, will do much to help in this fight.
First, the use of the information in civil cases does not assist the federal
government in any way. Most civil cases are between private parties and very
rarely involve federal or state governments. The use of the information does
not help combat the threat of terrorism, which is what the proposal states the
information is collected for. There is no need for the information to go to a
civil case and to do so is clearly an unauthorized expansion of the fight on
terrorism. It is doubtful, in a divorce case, that terrorism is involved.
Also, the fact that the information could be exempted from the Freedom of
Information Act is questionable. When information is collected on a person,
they should have the right to see the information collected, by whom, when, and
if any governmental agency has requested the information. This allows a person
to contest the information collected or understand who has the information. If
someone's identification is stolen, this would also help them find out if the
identification was ever used.
I understand the need to track people who travel over land. Other forms of
transportation has always been gathered, but the purpose of this bill could be
more narrowly tailored to meet the need.
