In this notice of proposed rulemaking, DHS is now proposing to exempt DHS/ICE--011 Removable Alien Records System, in part, from certain provisions of the Privacy Act. ***Response**** Alien records should not be exempt from any provisions of the Privacy Act. Even if an alien is consider to be unlawfully in the United States at a certain point in time, it does not signify that he should not be protected by the same rules protecting citizens and legal residents; for the reason that an alien may adjust and change their unlawful status, therefore eventually being protected under the same laws. Allowing such exemptions would also allow discrimination of a potential citizen or legal resident.
