Provided the pornographic materials do not depict illegal photos (i.e. photos of minors or photos taken unwillingly or under duress), I believe that the production and distribution of pornography are forms of free speech. The first amendment protects free speech, and pornography does not impinge on people's rights. So following that argument regulating pornography is unconstitutional. If we can allow books and videos of non-real violent scenes, and we assume that adults have the capability to distinguish between the real and the unreal, should we not similarly consider pornography as non-real fantasies of men? And consequently shouldn't we expect adults who wish to view pornography to make the same distinction between the real and non-real?
