The proposed rule is how the law should have been written in the 1st place. the
confusion over cafeteria plans has had the opposite of the intended effect of the
law.
It has allowed employers to discriminate against TRICARE enrollees by denying
them the same cafeteria plan and benefits as all other employees. This has been
a savings to the employer and not TRICARE as stated under the law.
At my employer this has been a reduction of $403 per month in TRICARE
enrollees pay starting 01/01/08.
My employer is refusing to aknowledge the true intent of the law even after seeing
the proposed rule.
I urge passage of this rule ASAP to end the blatant attempt by employers to get
out of paying Union negotiated benefits.
