The proposed rule (Docket ID: DOD-2010-OS-0183 Privacy Implementation) could possibly be viewed as a violation of our constitutional rights as U.S. Citizen. Although the contents of the U.S. Constitution contains no specifics on “rights to privacy” for U.S. Citizens, the 14th Amendment protects against state infringement and prohibits the state from interfering with privileges, the 3rd Amendment provides privacy of possessions and the 5th amendment protects against deprivation without the presence of due process. In the case of Docket ID: DOD-2010-OS-0183 (Privacy Implementation), the most important would be the 6th Amendment which provides citizens with the right to be informed. Thus, the providing of the answers and/or answer keys should be at the discretion of the test taker i.e. U.S. Citizens. Conclusively this would provide the avoidance of any implications of violations of a U.S. Citizens Constitutional right.
