I am extremely angry over the issue with Berkley and the Hearst Museum's lack
of cooperation with NAGPRA. and I am sure they are not the only agency guilty of
non cooperation with NAGPRA laws. Is it possible to write into the NAGPRA laws
that all applicable agencies holding human remains, funiary, ceremonial and
sacred objects who do not comply with NAGPRA"S Laws and time lines as to
tribal repatriation or returning unidentifiable,unclaimed remains and above objects
to the place of origin where they were originally found, that NAGPRA could devise
a provision enabling NAGPRA itself to confiscate said remains and objects from
those places that refuse to comply and take over control of them so they can be
readily available for proper re interment thru tribal applications or returned to the
place they were found? I never thought of this at the time I wrote my comments
here the other day. Many such agencies have not complied with NAGPRA's
criteria and time frame for accomplishing the complete cateloging ,testing, and
processing tribal requests. I think a penalty of losing their collections to NAGPRA
agents for not complying is a reasonable provision. They have had since 1990 to
do this. I know NAGPRA itself would see that these remains and items would be
properly processed and placed with coinsiding tribes once in their care. The
unidentified cultural remains could then be turned over to the THPO's living near
the areas where the remains and objects were found to properly re inter them.
