The Department of the Interior?s (DOI) proposed revision to 40 C.F.R. ? 2.30(b)
(?How do I file an appeal??) gives power to the FOIA Appeals Officer to
summarily reject any appeal that it deems incomplete. This change constitutes a
substantive amendment to the rule, rather than a mere clarification, as DOI
claims in the preamble. DOI should strike this amendment, as it will make ?
2.30(b) too vague and will harm appellants' abilities to file timely FOIA appeals.
