INGAA supports the Department?s efforts to provide guidance on the implementation of NEPA and to codify such guidance as regulations. Most of the proposed regulations are clear, helpful, and consistent with case law and existing regulations and guidance from the Council on Environmental Quality (CEQ). However, a few of the proposed provisions may pose problems when implemented and would benefit from revision or further clarification.
