I have been a Bankruptcy Trustee or many years. Trustees (All Chapters) should
not be placed with additional Reporting Burdens. In No-Asset Cases the Trustees
are paid $60 to Investigate the Case and conduct the Section 341 Hearing. The
proposed Rule Requires submitting detailed Reports concerning all assets and all
claims to the U.S.Trustee (U.S.T.) for review and U.S.T. approval. This will
increase the amount of work required of the case trustee ---- Case trustees are
paid $60 Max. per case. Also in some of these cases there is no payment to the
trustee when the filing fees are waived or not paid by the debtor.. Presently a
simple one paragraph report is filed with the Court in No-Asset cases.
Some consideration should also be given of the U.S. Trustee's potential refusal to
approve Reports, the costs to prepare and mail these reports to the U.S.T.
I would also request that the Trustee's Final Report (TFR) in Smaller cases (Less
than $10K) be simplified.
