There should be five groupings not four. Jails should be a separate group in and of itself for the following reasons:
Prisons hold only sentenced prisoners. Most of the prisoners held in prison are convicted of serious crimes and have sentences greater than one year.
Prisons hold a greater number of people.
The majority of prisons are state run.
The budgets for prisons are much higher and can provide for better medical, mental and dental health coverage as well as all sorts of other beneficial programming.
Jails vary in size and design from two beds to a thousand plus beds.
Jails hold various types of prisoners from pre-trial detainees, probation and parole violators, illegal aliens, and the list goes on.
Jails hold prisoners from a few hours up to a year in custody with most going in and out within 72 hours.
Jails budgets are small and usually part of a Sheriff’s office budget. Most lack basic in-house medical care with little to no mental or dental health care and other programming is usually non-existent.
People just do not realize that there are major differences between “Prisons” and “Jails” yet they try to put them together and in this case one size does not fit all and the burden placed upon jails nationally will be extreme and the majority will not be able to comply contrary to what has been stated in the act.
