It is often in both the Government's and the contractor's best interest to retain as many of the incumbent employees as possible. However, any law that required it would be opposed by many in industry. An incoming contractor should have the ability to set the standards it requires of its employees, and these standards may be higher than those of the incumbent. It would be disruptive for the Government to step in and ensure that we retain certain individuals for a particular length of time, if that is being contemplated. It will be excessively burdensome for contractors to have the Government essentially in charge of selecting and managing a contractor's workforce. In addition, it would inhibit the potential for competition by discouraging companies from competing for work, particularly work previously performed by federal employees.
