Comment on DOS-2011-0080-0001

I am concerned about offering a contract to work to a person I have never had the opportunity to interview. The past year I had a J-1 employee who had excellent language skills and a good CV. However, after a week employment I discovered he did not fit with my business. If employment for a U.S. employee is 'at will' how can I justify being locked into some form of contract with a foreign employee? Also, being a small business, I have too much pulling me in 10 different directions without adding any additional reporting requirements.
