The term “enrolled” is defined in 668.2 (see below), and its use interchangeably with the word “attend” in the context of MAP-21 creates policy concepts that are inconsistent. If the Department intends that the provisions apply to students who actually begin attendance in the program of study for which the loan funds are disbursed, then the appropriate word would be “attend” and its variations. If, however, the Department intends that the provisions apply to students who complete the registration process or who have been admitted to an education program offered by correspondence, then the appropriate word is “enroll” and its variations.
From the content of the provisions, we believe that the Department means to apply MAP-21 restrictions based on actual attendance in the program for which the student is enrolled. Thus, we suggest that the regulation be re-written using that term.
34 CFR 668.2:
Enrolled: The status of a student who—
(1) Has completed the registration requirements (except for the payment of tuition and fees) at the institution that he or she is attending; or
(2) Has been admitted into an educational program offered predominantly by correspondence and has submitted one lesson, completed by him or her after acceptance for enrollment and without the help of a representative of the institution.
