In 2006, I was diagnosed with multiple sclerosis. Prior to the diagnosis, I was experiencing symptoms that I am sure affected my performance at work. At that time, my work performance had been poorly rated, and I missed out on raises and bonuses. In hindsight, I am sure that the performance problems were due to cognitive difficulties related to the MS. What options do I have to recoup on what I was denied due to my disability, even though at the time I was not aware that I had a disability? Will the amendments to the ADA allow this to happen?
I am glad to find out that the definition of disability has been expanded. There should never be a reason to discriminate against anyone due to a disability that is not under their control.
