Stay of CAIR and CAIR FIP for Minnesota Only Proposed Rule Docket ID No. EPA-HQ-OAR-2009-0021 74 Fed. Reg. 22147 (May 12, 2009) Rochester Public Utilities (RPU) appreciates the opportunity to a file comment on EPA’s Proposed Rule concerning the stay of CAIR and CAIR FIP for Minnesota Only Proposed Rule (40 CFR Parts 51 and 52, Docket ID No. EPA–HQ–OAR– 2009– 0021, as published in the Federal Register on May 12, 2009). Rochester Public Utilities (RPU) fully supports the proposal by EPA to stay the effectiveness of CAIR and the CAIR FIP with respect to sources in Minnesota only, while EPA conducts a notice-and-comment rulemaking addressing this issue and its impact on the inclusion of Minnesota in CAIR. RPU feels that any determination on the inclusion of Minnesota in a replacement rule to CAIR should be based on valid and representative data of the State of Minnesota.
