I am writing to express concern that the data for the transport rule that EPA provided notice for in the October 27, 2010 Federal Register has not yet been posted on EPA website. Given the short review period (30 days) provided, the failure to post these data up to this point has effectively reduced the comment period by at least 5 days. Parties interested in reviewing and commenting on these data will, therefore, not be afforded the entire review period announced in the notice.
Regrettably, this follows the pattern of delayed data posting experienced with the original transport rule proposal and the September 1, 2010 Notice of Data Availability. As with those reviews, this shortened review period seriously impacts our ability to complete a thorough review and develop meaningful comments. It is vital that EPA provide ample opportunity to review the data behind this important proposed rule so that interested parties can provide comments that will assist EPA in its decision making process.
