Ms. Hambrick, This pertains to HMIWI state plan requirements for the state of Alabama. Within the proposed rule, published in the April 23, 2012 Federal Register (77FR24272), it lists Alabama as one of the states which EPA has not received a negative declaration (item VI. Page 24275 in the table). We believe this to be incorrect. Attached per your conversation with Lisa Cole today, is a copy of the Negative Declaration letter submitted February 8, 2010, for existing HMIWI facilities in Alabama.
