Clearly the agency needs adequate time to respond to the decision of the Second Circuit Court of Appeals in Waterkeeper Alliance et al. v. EPA and make appropriate revisions to the CAFO rules. Without specific information on EPA’s progress in revising the CAFO rules, we have to assume that delayng implementation of NPDES permit coverage to March 30, 2007 is adequate. However, once the second revised rules are published and the timeline for implementing them is more fully established, we expect to comment on the most appropriate date for implementation of the revised CAFO rules.
