The proposed rule, to eliminate federal oversight of all water transfers, seems
highly inappropriate. Although most transfers fall in the category of infrastructure
development and do not constitute a direct pollutant discharge, there are some
that should be considered discharge of a pollutant. It is important to keep NPDES
authority in place to prevent any transfers that would result in a violation of water
quality standards of the receiving waters.
