Approval and Promulgation of Air Quality Implementation Plan; Alabama; Disapproval of Interstate Transport Submission for the 2006 24-Hour PM2. (2011-1628) Docket: EPA-R04-OAR-2010-1013-201064 Proposed Rule: 76 FR 4588 Relevant Rule: 40 CFR 52 The Interstate Transport Submission for 2006 24 hr, PM 2.5 Standard is promulgated every three years. The implemented plan submitted was to address a plan whether implemented, revised or maintained that will be approve by the EPA. The EPA addressed the standards which must be met in accordance with the Clean Air Act (CAA) 110 (a) (2) (D). Therefore, giving the Administrator the right to approve or disapprove partially. It appears this plan was disapprove based on the changes that were made to the NAAQS, (National Ambient Air Quality Standard). With this being the case, disapproval can be done if the plan indicate that there is provisions or interference or advancing attainment to other states. The EPA suggests there was not adequate clarity in the plan that address issues of necessity, therefore not meeting the requirements of the Act. I think that to implement new provisions or revises to the 2006 24 hr. PM 2.5, by decreasing the amount of primary and secondary NAAQS, will give the state a chance to implement a plan of infrastructure which will allow approval. Other than this failure to meet the requirement, it appears other requirements were met. Therefore, decision appears feasible.
