Extension request of the Public Comment Period for the Proposed Approval of the PM 2.5 Clean Data Determination for Milwaukee-Racine, Wisconsin

Mr. Aburano, On behalf of the Sierra Club and Midwest Environmental Defense Center, I write to request that EPA provide at least an additional 30 days of comment period on its proposal to find that the Wisconsin Milwaukee‐Racine Nonattainment Area achieved compliance with the 24‐ hour final PM (PM2.5) standard. As EPA’s notice acknowledges, 77 Fed Reg at 24438, Wisconsin closed two monitoring locations in 2010 that were showing some of the highest PM2.5 readings (in violations of the NAAQS). If averages were taken only from the years when data exist—those locations would show nonattainment. Notably, EPA has requested that Wisconsin reestablish one monitor location as of the beginning of 2012. The data from that monitor will be relevant to EPA’s analysis. We have requested that Wisconsin provide us with the data from the re‐established monitor (Site Number 550790099). However, Wisconsin DNR asserts that the data will not be available until the end of May. The comment period will close before those relevant data are available unless EPA extends the comment deadline.
