I want to express objection to the Environmental Protection Agency’s decision to interfere with the State of North Dakota’s implementation of the regional haze rules, docket number EPA-R08-OAR-2010-0406. Congress left the primary responsibly to the states to develop state implementation plans. Under the law EPA is allowed to disapprove a state’s plan only when a state fails to take into account the factors specified in the regional haze regulations.
