EVA (EVA Airways Corp.) is in process of AD Notice of Proposed Rulemaking Docket No. FA-2009-0790. The new requirement of this FAA AD is similar as EASA AD 2008-0173. However refer to Airbus message SR Ref: SEEE2-2008-280124 (As attached). Airbus confirm that once the APU Generator secondary housing is installed, EASA AD 2008-0173 requirement are no more applicable, and therefore, MMEL 24-22-01 will revert to previous "configuration" once APU GEN Secondary Housing installed on A/C (Cat C 10 days without any check of the APU Generator scavenge oil filter and APU Generator drain plug). Thererfore, the acatin required by paragraph (h)(5) of this new FAA proposed AD should be revised as "Performing the secondary housing over APU GEN installation terminates the repetitive inspection required by paragraphs (g)(2), (g)(3), (h)(2), (h)(3)and (h)(4) of this AD".
