[Docket No. FAA–2010–0040; Directorate Identifier 2008–NM–203–AD]: Please be informed that the Airbus A330/A340 fleet is not affected. The complete list of SICMA seat series fitted with backrest links P/N 90-000200-104-1 and P/N 90-000200-104-2 (affected and exceptions) and taken as reference for the AD applicability is the annex from SICMA VSB No 90-25-013. After further review on delivered A330/A340 fleet, no airplane has been found affected. In addition, parallel DGAC AD 2001-613(AB) was not validated for A330/A340 fleet because all certified seats were considered 16G (and not 9G). First A340/A330 were delivered with 9G but FAA requires 16G and according type definition it has been also corrected to elect to 16G. Therefore we would recommend removing A330–200 and A330–300 series airplanes from the NPRM applicability. Thank you in advance. Best Regards
