I would stipulate that the regulation arbitrarily excludes retractible landing gear without justification. I fly a two place Glasair I RG that I built with a 180 HP Lycoming. The added complexity of the landing gear operation is miniscule in terms of the overall safe operation of the aircraft. I've been a private SEL pilot for 43 years and 2,000 hours total time of which 900 have been in retractible aircraft. I've never had an incident that involved the landing gear as a safety of flight issue, hazard to any ground personnel or my passenger.
