FAR 9.108-5 requires the inclusion of the provision at FAR 52.209-2 ("the IDC provision") in certain solicitations. FAR 4.1202(f) indicates that the IDC provision is not to be included in a solicitation when the clause at FAR 52.207-7 is included. However, unlike the other provisions listed in FAR 4.1202, the IDC provision is not listed in the provision at FAR 52.204-8, which makes provisions completed via the Online Representations and Certifications Application (ORCA) applicable to a particular solicitation. Thus if the IDC provision is not included in a solicitation in accordance with FAR 4.1202(f), the IDC provision will not be applicable to the solicitation, even if it's completed via ORCA.
