Contractors should be permitted to determine the best resources to meet contractual requirements without restrictions. Contractors should be encouraged but not required to retain 'qualified incumbents'. Incoming contactors have their own standards, procedures, processes as well as qualified resources to use to meet and exceed requirements. Existing workers may be slow or resistant to adopt changes that the incoming contractor may feel are necesary to meet goals. Also, incoming contractors may have better qualified employees with proven capabilities that they may be able to offer promotion opportunities after award of a new contract.
How does this rule change benefit the American taxpayer? Why is the government trying to regulate an employers right to hire workers to meet their requirements. The right to hire is a fundamental corporate right and I do not believe that right should be impeded by the government. Incoming contractors know the capabilities of their employees and the personnel thay have proposed but must rely on the government or a competitior primarily in assessing the skills of incumbent workers. Will the government assume the responsibility and/or risk if the incumbent worker does not perform under the new contractor?
