The following is proposed under 42.1503(a) - 2nd and 3rd sentences - "Agency procedures shall identify and assign past performance evaluation roles and responsibilities to those individuals responsible for preparing interim and final performance evaluations (e.g., contracting officer representatives and program managers). If agency procedures do not specify the individuals responsible for past performance evaluation duties, the contracting officer will remain responsible for this function." Comment: The proposed 3rd sentence outlined above states that “the contracting officer will remain responsible” for past performance evaluation duties if agency procedures do not specify the individuals responsible. Where are past performance evaluation duties established in the FAR as the responsibility of the contracting officer to justify use of the term “remain?” The requiring activity/technical office that identifies the requirement is considered to be in the best position to evaluate contractor performance and thus should be held responsible for performance evaluation. Current DoD CPARs policy places responsibility for performance evaluation on program managers or the equivalent individual responsible for program, project, or task/job/delivery order execution. It is requested that the council consider revising the proposed sentence as follows: “If agency procedures do not specify the individuals responsible for past performance evaluation duties, the requiring activity/technical office remains responsible for this function.” Also, it is requested that the council consider defining “requiring activity/technical office.
