Though I am sure the intent is to cover such workers, the proposed rule does not
appear to address professionals who are not employees but rather work as
independent subcontractors. Such people would include physicians or other
healthcare professionals, consultants, lawyers, etc. Companies are not required
to obtain Form I-9 for such persons, although in the case of physicians at least,
verification of legal resident status occurs through other means prior to placement
in federal medical facilities. The ruling should address whether or not verification
through E-Verify is required for independent subcontractors and if it includes all
such individuals or just certain classes/specialties.
