FEMA has published a proposed regulation which would impose a reduction of the federal cost share to 25% for restoration of public and eligible private nonprofit facilities that have been damaged three times by the same type of event within a ten year period and have not undergone appropriate mitigation measures before the third event.
This proposed regulation that would implement the provision of the Disaster Mitigation Act of 2000 should to take into consideration that funding available to implement mitigation varies from year to year, and on a competitive basis through the Pre-disaster Mitigation Grant and Hazard Mitigation Grant Program. The proposed rule-making should take into consideration the following as part of the evaluation process:
The INTENT of the jurisdiction to apply for federal funding or by other means, even if funding was not awarded to implement mitigation measures, should not be penalized.
