Rather than resdignating 31 CFR § 103.59 as § 1010.840, FinCen should delete the rule in its entirety. The rule, which provides for various criminal penalties, has been supserseded by amendments to the Bank Secrecy Act. Continued publication of the rule is misleading because Congress increased the criminal penalties and eliminated the "willful" requirement for criminal prosecutions of violations of the BSA. It makes no sense to confuse the public with the republication of a regulation that misstates and understates current statutory prescriptions.
