Dart's request should be denied due in fact that the HOS regulations are not a "one size fits all" regulations. The regulations will suit some motor carrier operations better than others and jthe fact that a regulation doesn't fit the way a motor carrier would desire should not be grounds for an exemption. The industry at large effectively finds ways to make these regulations fit their particular operations it should be Dart's responsibility to do so, as well. Additionally, a review of the motor carriers Safestat report indicates a large number of driver OOS vilolations in two areas . . . HOS and unqualified drivers. This carrier should be required to improve it OOS numbers before being considered for any type of exemption.
