I believe that prior history of no CMV issues should contribute heavily to a decision in this matter. Mr. Anderson have driven for 36 years and appears to be a very qualified driver of commercial vehicles and therefore should be allowed to continue operating a commercial vehicle. It is my opinion that Mr. Anderson should be reinstated by his present employer and allowed to operate the commercial vehicle that is required for all drivers of the present employer without prejudice to age, disability, or national origin. Mr. Anderson should get a full waiver and is entitled to be employed as an operator of commercial vehicles.
