The people who start these companies and shut them down put their wives, kids, etc. and/or several legal entities to thwart the government from monitoring their business and/or keep workers puzzled as to who to hold responsible when they fail to keep FMCSA/DOT rules. The only way to ensure that they do not do that is to have a rule that is progressive in that if the company fails to comply with basic safety rules that the FMCSA/DOT monitor their financials more closely. Usually the bad actors are not using their resources to deal with the problems but only working to increase income for their owners. You can put up a wall to try to prevent them from opening a new company but they are going to find a loophole. Catch them and prevent them from going beyond the basics in safety or freeze their assets earlier in the game and don't let them escape to do anything with the assets once they have gone beyond the basics and have shown that they have no intention of complying with the rules.
