How does requiring 10 of the states (20%) to spend $27,125.00 to develop a grade crossing plan comport with our Constitutional guarantee of equal protection under the law? Worse the FRE does not put the ten unlucky states on notice at the beginning of the comment period to allow those affected to give this matter the attention that it deserves if they are to be selected. With tax revenues down across the nation, why is the FRA trying to ambush state governments in this manner? Did anyone at FRA read the President's memo on not pre-empting state laws unless absolutely necessary?
