Section 38.29 (b) On vehicles 22 feet in length or longer which have fare collection systems, a horizontal assist shall be provided across the front of the vehicle to allow a person to lean against the assist while paying a fare. [§ 38.29(b)]
The horizontal assist across the front of the vehicle assumes that all fareboxes are front mounted. In fact the drawing with reference D for the farebox and horizontal rail show a forward control or flat nose bus. Most cutaway buses mount the farebox beside and behind the driver seat, street side of the aisle. The driver barrier stanchion then serves as a hand hold for fare paying customers and eliminates the need for the front horizontal rail requirement as stated. In fact, forward mounted fare boxes can pose a visibility issue for the driver.
Please amend the language to reflect this situation.
