With the amount of oil and gas exploration that takes place, it would be nearly impossible to set up full regulations and ensure that only small amounts of Polar Bears and Walruses were unintentionally taken, particularly as no particular individual is assigned to this duty.
Thus, the general allowances that the act would provide simply encourage further oil and gas exploration, without also providing strong buffers to keep the system from being abused, which it easily could as Polar Bears and Walruses could also be used for profit.
