Western Riverside County Regional Conservation Authority ("RCA") is very disappointed that its previous comments regarding the impropriety of proposing any critical habitat within the boundaries of the Western Riverside County MSHCP were not addressed in the most recent draft rule revisions and economic analysis. Courts have found that the Service may exclude habitat covered under the MSHCP, and the Service explicitly agreed to do so when it signed the Implementing Agreement to the MSHCP.
