The Endangered Habitats League would like to add a clarificaition to comments previously submitted (on Sept 6, 2011) on the proposed exclusion of of the Coachella Valley MSHCP/NCCP from critical habitat under section 4(b)(2) of the Act. We believe that permittees of the Coachella Valley MSHCP/NCCP should be relieved of critical habitat obligations as long as the plan is properly functioning. However, non-permittees within the plan area should obtain no such benefits. Indeed, giving non-participants a "free ride" is a incentive not to participate in these large scale HCP/NCCPs.
