George Allen; I would like to thank you and the USFWS (Service) for the proposed revisions regarding the Migratory Bird Import and Export regulations. I agree with most of the proposed rule changes by the Service. I support the proposed 21.21(b),(c) and (d) where an import/export permit is not required but does require compliance with Parts 14, 15, 17, 21, 22 and 23. I would like to see Section 21.21 (c) (2) changed to allow both wild-caught and captive-bred raptors banded with numbered plastic bands issued by the Service, since they still need to meet the CITES requirements to receive a Passport for either. I agree with proposed 21.21(i) that would extend the validity of issued permits from three (3) to five (5) years. I would request a statement that falconers are exempt from specific designated ports of entry and may use any legal point of entry. Section 21.21 (c) (2) needs to define ?full documentation of the lawful origin of each raptor? as follows: 1) for captive bred seamless banded raptors, a Form 3 ? 186A or its replacement form; 2) for plastic banded captive bred or wild raptor, a state-issued permit. Without a definition of the clear meaning of the words ?full documentation? a dispute may arise as to what constitutes evidence of lawful origin. I agree with proposed 21.21(i) that would extend the validity of issued permits from three (3) to five (5) years A statement specifically allowing USFWS LE authority to allow falconers to recover lost birds across the US/Canada border without the typical 30-90 day wait period for a CITES permit would be appreciated. Also, allow Customs to stamp form 3-177 (Declaration of Import/Export) and/or allow it to be pre-approved by local/regional USFWS LE. I would like to thank you and the Service for considering falconers in that review.
