(e)(4)(ii)***Prior to transferring a live bird, you must submit a FWS Form3-202-12 to your migratory bird permit office and receive authorization for the transfer.
Comment:
Ideally I would like to see some exception stated to cover the scenario of immediate transfers. When a member of the public brings us a species which we cannot rehabilitate but another rehabber can, we would like to still accept that bird from the public to immediately transfer to the other rehabber. This is a much better scenario than sending the bird back in the possession of the public for them to (hopefully) transport to the other rehabber. And alternatively, it’s not the best situation for us to hold the bird waiting for USFW approval before transferring to the appropriate rehabber.
