80.50 What activities are eligible for funding under the Pittman-Robertson Wildlife Restoration Act?
This section lists the activities that are approved for funding under the Act. Technical Assistance or Technical Guidance for land owners, land managers, NGO's, other government agencies and others is not specifically listed. It can be read that Technical Assistance is part of (a) (1) Restore or manage wildllife. We recommend that Technical Assistance be specifically stated as an eligible activity under the Act.
80.123(c) How may an agency use program income?
Under (c) the proposed rule lists the criteria under which the Regional Director may approve the use of program income as match. It would be difficult to find any grant request that did not meet these criteria. If this is an approved method of using program income it should not require approval at any higher authority than any other grant. If the use of program income as a match is intended only as the result of some catastrophic event then that should be stated. As it is now stated it is not clear when approval would be granted since the proposed rule states the Regional Director "may" approve the use. We recommend that program income should either be approved as match on all grants or not on any or that additional sideboards be added to better define when this method of using program income is applicable.
