The Texas State Agency for Surplus Property (TXSASP) would like to make the following comments on FMR case 2009-102-3:
Concerning the proposed rule change to the Exchange Sale Authority. TXSASP agrees with NASASP, that the rule should not change as proposed. TXSASP has many museums and aviation training schools that would lose the benefit of having aircraft and aircraft components available to them through the donation process. TXSASP would request that aircraft and aircraft components continue to run through the current process that would allow for screening by Federal agencies and then to State agencies prior to going to sales.
If anything the Exchange Sale Authority should only be used if the holding agency correctly submits documentation that the proceeds from any sale be used as the rule is intended. That is, that the funds received from the sale of such property be used to purchase a like items. To use funds from Exchange Sale any other way is an abuse of the rule and should be subject to review.
