The National Association of State Agencies for Surplus Property, Inc agrees and commends GSA for the clarification and edits in this specific case. However we do one additional comment as relates now to DOD property specifically.
"By revising the FMR to include eligibility for Veteran's GSA has taken a major step towards providing for the needs of VSOs around the country. However there is a further step that must be considered in order to help Veterans and all eligible donee organizations under the Federal Surplus Property Program. The Federal Acquisition Regulations (FAR) now needs to be addressed concerning disposition of Government Contractor Property. Currently there are only two avenues for disposition of contractor owned property when a contractor receives Federal contract awards --either the property must be sold or scrapped and in the current environment neither solution is efficient or green. Most items are scrapped in that the cost of care and handling exceed expected proceeds. In order for the taxpayers to receive the maximum benefit and life of the property there must be another alternative and that is the ability to donate the property to eligible recipients under Title 40, Section 549. The FAR must be revised to reflect the proposed changes being currently considered for the FMR.”
Specifically the FAR requires:
FAR 31.205-8 -- Contributions or Donations.
Contributions or donations, including cash, property and services, regardless of recipient, are unallowable, except as provided in 31.205-1(e)(3) and zero net book value items provided to organizations identified in CFR part 102–37.380, including veterans organizations.
