We are a regional health plan, licensed to operate in an area that is less than statewide. As a regional health plan, we require all members (subscribers, spouses, domestic partners, children and other dependents, except those covered under a medical support order) to live or work within our licensed service area. (We do not require dependents to live with the subscribers, however, they must live within the service area.) We would like to confirm that we will be permitted to continue applying this live/work rule to all members (including dependents) for plan years after September 23, 2010. Because our provider network only covers our licensed service area, any members enrolled in the health plan who do not live or work within the service area or who live in another state would not have timely access to non-emergency health care services.
