This comment pertains to Sec.156.280 (Segregation of funds for abortion services) of Proposed Rule on Exchange Functions in the Individual Market: Eligibility Determinations; Exchange Standards for Employers: 1. The same protections that are extended to a state that chooses to opt out of coverage should be provided to a state that choses to opt in to providing coverage (ie mandate coverage); 2. A QHP to which paragraph (e)(1) applies should be able to collect separate payments described in section (e)(2) in the form of one payment vehicle; 3. Clause (g) should address discrimination against both providers who are willing and not willing to provide, pay for, provide coverage of, or refer for abortions.
