Homeowner and condominium owners that are subjected to homeowner associations are under contractual obligations to those associations. Contractual law prohibits charging fees or fines for non-performance. The only remedy the offended party has is to go to the courts to demand performance. As such, the states that have permitted these associations to put liens on private property have enacted bad law. On behalf of all homeowners subjected to the tyranny of associations that have run amok, I ask that you consider making the FHA-insured mortgages a primary mortgage and not allowing any other entity the ability to foreclose. Thank you.
