Purpose: Specific comments - safe harbor for compliance with the Fair Housing
Act.
For the past 14 years, Access Technologies Services, Inc. (ACCESS) has been
plan checking drawings, auditing construction, and rendering opinions regarding
compliance to the Fair Housing act.
I agree with HUD, that the standard for design and construction should be ANSI
A117.1. I have reviewed the proposed changes to ANSI A117.1, which is on a 5-
year cycle; so, the new ANSI will be 2008. Each new ANSI A117.1 gives us
additional information, sometimes conflicting with older versions.
In my opinion, for HUD to say that the 1986, 1992, and 1998 editions also remain
sufficient to meet the design and construction requirements of the Fair Housing
Act is wrong. In fact, HUD should be saying just the opposite: that the 1986,
1992, and 1998 editions do NOT meet the requirements but that the 2003 edition
does. If HUD does not say this, then the matter will be litigated and a federal
judge will say this based on prevailing inconsistencies and common sense.
